Terms of Use

The short version
  • TrickleDown.io is a free, satirical game. Every billionaire in it is fictional.
  • The money in the game is imaginary. It has no cash value, and no real money is moved or donated.
  • Play, share, stream and make videos of it. Don't cheat the servers, scrape it, or copy the game.
  • It's provided "as is", and disputes go to individual arbitration in California.

1. Agreement

These Terms are an agreement between you and Shinobit LLC ("Shinobit", "we", "us"), the company that makes and runs TrickleDown.io (the "Game"). By using the Game you accept these Terms and our Privacy Policy. If you don't agree, please don't use the Game. If you use the Game for an organization, you accept these Terms on its behalf.

2. Satire and fictional characters

The Game is a parody about extreme wealth in general. Every billionaire character, together with their name, likeness, company, description and quotes, is invented. None depicts or refers to a real person or business, and any resemblance is coincidental. Nothing in the Game is a statement of fact about anyone.

3. In-game money and "what it could pay for"

Dollars, fortunes, dividends, totals and other amounts in the Game are fictional game values. They have no monetary value, can't be exchanged, withdrawn or transferred, and aren't property of any kind. The comparisons on the Stats page (teacher salaries, school meals and so on) are rough illustrative averages to show scale. They aren't real quotes, and no donation or payment is made by you or by us when you play.

4. Who can play

The Game is meant for a general audience and isn't directed at children under 13. If you're under the age of majority where you live, use the Game with the permission of a parent or guardian, who accepts these Terms for you.

5. Your license to play

We give you a personal, non-exclusive, non-transferable, revocable license to play the Game in a web browser for your own non-commercial entertainment. You agree not to:

Using auto-clickers or editing your own save in your own browser only affects you, and we don't mind.

6. Sharing, streaming and videos

You're welcome to share links, screenshots and your stats, and to stream or publish videos of your gameplay, including monetized videos, as long as you don't present the Game as your own or imply that we endorse you. We may ask you to remove content that breaks these Terms.

7. Ownership

The Game and everything in it, including code, characters, artwork, text, design, sound effects, the TrickleDown.io name and logo, are owned by Shinobit or its licensors and protected by intellectual property laws. Some content, such as the background music, is licensed from third parties. Anything not expressly granted in these Terms is reserved.

If you send us ideas or feedback, we may use them freely without paying you or owing you anything.

8. Advertising and third-party links

The Game is free because it shows ads, including ads served by Google. Ads and links to other websites (such as the share buttons) are provided by third parties. We aren't responsible for their content, products or practices, and your dealings with them are between you and them.

9. Your progress

Progress is saved only in your browser. It can be lost if you clear your browser data, use private browsing, switch devices or browsers, or if your browser deletes it. We can't recover it. Use "Copy save code" on the Stats page to keep a backup. We may change or rebalance the Game, reset or change seasons, or add and remove features at any time.

10. Availability and changes

We may change, suspend or stop the Game, in whole or in part, at any time and without notice. We may also change these Terms. When we do, we'll update the effective date above. If you keep using the Game after a change takes effect, you accept the new Terms.

11. Disclaimer

The Game is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We don't promise the Game will be uninterrupted, error-free, secure or free of harmful components, or that your progress will be kept.

12. Limitation of liability

To the fullest extent the law allows, Shinobit and its members, employees and licensors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, data (including game progress), goodwill or use, arising from or related to the Game or these Terms, even if advised of the possibility. Our total liability for all claims related to the Game will not exceed one hundred US dollars (US $100).

Some places don't allow some of these exclusions or limits, so they may not fully apply to you. Nothing in these Terms limits liability that can't be limited by law.

13. Indemnity

If you break these Terms or the law while using the Game and a third party makes a claim against Shinobit because of it, you agree to cover Shinobit's reasonable losses and costs, including reasonable attorneys' fees, to the extent the law allows.

14. Disputes: arbitration and class-action waiver

Please read this section carefully. It affects your rights.

If you have a problem, email [email protected] first, and we'll try to resolve it informally within 60 days. If we can't, you and Shinobit agree that any dispute arising from or relating to the Game or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, held in Sacramento County, California, or remotely. Either party may instead bring an individual claim in small claims court, or seek an injunction in court to stop infringement of intellectual property.

Class-action waiver: disputes will be resolved only on an individual basis, not as a plaintiff or class member in any class, consolidated or representative action. If this waiver is found unenforceable for a claim, that claim will be decided in court, not arbitration.

Opt-out: you may opt out of this arbitration agreement by emailing [email protected] within 30 days of first using the Game, with your name and a statement that you opt out.

15. Governing law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules. Where a dispute is heard in court, the state and federal courts in Sacramento County, California have exclusive jurisdiction, and you and Shinobit consent to them. If you're a consumer living in the EU or UK, you keep the protection of the mandatory laws of your country and may bring claims in your local courts.

16. General

These Terms and the Privacy Policy are the entire agreement between you and Shinobit about the Game. If any part is found unenforceable, the rest stays in effect. Our not enforcing a provision isn't a waiver. You may not transfer these Terms, but we may transfer them as part of a merger, acquisition or sale of assets.
